A CLARA man raised his middle finger at a passing Garda car, the December 10 sitting of Tullamore District Court was told.
Norman Murray, 9 Westwood Grove Clara was charged with threatening, abusive and insulting behaviour in a public place on Ballycumber Road, Clara on August 10 last.
Sergeant Brendan Kearns told the court that a Garda patrol car was passing Mr Murray as he walked on a footpath when he gesticulated with his middle finger towards the car.
Garda Dermot McDermott stopped the car to talk to Mr Murray and the defendant became verbally abusive towards him. He had a number of previous convictions.
The defending solicitor Patrick Martin said his actions were caused by drink “and my client doesn't usually drink.”
Mr Martin said his client is an electrician and is in an eight year relationship.
Judge Andrew Cody ordered that the defendant donate €500 to St Vincent de Paul and he struck the case out.
