Portlaoise District Court
A judge dismissed a prosecution against a woman who breached a Safety Order by speaking to her own daughter.
The woman (33), who has a Tipperary address, admitted breaching the Safety Order in Laois last September 5, 2024.
Garda Sergeant JJ Kirby said gardai had been made aware of the breach by the ex partner of the woman. He said it was alleged she had spoken to her daughter as the girl was returning home from training. It is alleged she had invited her daughter into her apartment at 2.45pm on the date in question.
Solicitor Barry Fitzgerald described it was a “technical breach” of the safety order. “She shouldn’t have been talking to her daughter,” he said.
Mr Fitzgerald said it was a “natural instinct” for a mother to talk to their child.
Judge Susan Fay asked about the safety order at the sitting of Portlaoise District Court. She noted the “safety order in place is that she is not allowed to speak to her own child.”
“I am going to mark it facts proven and dismiss,” said Judge Fay.
