Suspended prison sentence for Offaly man who threw eggs at aunt's house

An Offaly man was given a suspended prison sentence for throwing eggs at his aunt's house during the January 8 sitting of Tullamore District Court.

Brian Mahon, Ard Abhainn, Banagher committed the offence at 23, Cuba Avenue, Banagher on September 23 last.

He was also charged with throwing “the drop bar of the front gate at the house, damaging a flower pot.”

Sergeant Brendan Kearns told the court that the incident happened at 6.20am and the injured party was in bed.

“The noise woke her up and she saw her nephew throwing the eggs at the front of the house. The flower pot was worth €50.”

The defending solicitor Aisling Maloney said her client is 46 years of age. “He has put his hands up at the first opportunity.”

She said the incident arose because of a dispute between the nephew and the aunt over a will.

“Is throwing eggs at the house some sort of alternative form of dispute resolution?” asked Judge Andrew Cody.

“He was feeling a deep sense of frustration at the time,” replied the solicitor.

“What age is the injured party?” asked the Judge. Sergeant Kearns said 80 years old.

“Will he do something like this again?” continued the Judge. “I haven't heard any form of an apology from him yet.”

“My client does apologise,” commented Ms Maloney, adding that “he is in a difficult financial situation.”

The Judge convicted and sentenced to a month's imprisonment, suspending for two years.

He ordered that Mr Mahon make no contact, either indirectly or directly, with the injured party; and that he not walk past the injured party's house when walking around the town.
