A man who had no permission to call into a house made the babysitter feel very uncomfortable
A man who called into a house in Kilbeggan had made the babysitter feel uncomfortable.
Before Tullamore district court was Michael Lally, McCauley Drive, Birr. Mr Lally committed the offence on January 18, 2022.
The 19 year old babysitter told gardai the defendant said he was calling to see if everything was alright. She was uncomfortable as there was a smell of drink from him. He had no permission to be there.
Solicitor Donal Farrelly said the defendant had a serious alcohol problem. He had entered the home regularly as a visitor but admits he shouldn't have gone in on this occasion. He has engaged with a Restorative Justice programme.
Sgt James O'Sullivan said Mr Lally had 11 previous convictions for road traffic offences and on June 19, 2019 he had committed public order offences and criminal damage.
Mr Farrelly said Mr Lally had a relatively good record. He has considerable debts, he told the judge.
Judge Andrew Cody noted there was a positive probation report but said Mr Lally was due to bring €250 to court.
He put the case back to December 14, 2022. He said if he pays he will apply the probation of offenders act.
Mr Lally also pleaded guilty to a summons for being drunk and abusive to gardai.
In his evidence to the court Sgt James O'Sullivan said that on March 8, 2022 at 1.15pm in Birr Gardai observed a male unsteady on his feet. When they approached him Michael Lally told them to f..k off and get to f..k off and leave me to f..k alone. He was taken to the garda station.
On May 8 , 2022 at 1pm he punched the roof of a taxi at Main Street, Birr, causing €570 worth of damage. He also damaged a flower pot worth €80 at Emmet Square in Birr.
Solicitor Donal Farrelly said Mr Lally's partner was expecting a baby and is attending doctors. He is also receiving psychiatric care.
Judge Andrew Cody said he has a six month suspended sentence hanging over him. He said I need to see evidence that he is doing something to address his issues.
He adjourned the case to December 7, 2022. He needs to produce more than an App, he said.
