Driver clocked exceeding limit on Dublin-Galway motorway
A DRIVER who admitted travelling at a speed of 141kph on the Dublin-Galway motorway nonetheless had a summons against him for that alleged offence dismissed.
John Paul Healy (45), Dublin Road, Rochfortbridge, Co Westmeath appeared in court where his solicitor, Patrick Martin said he had been in holidays in Malaga and didn't have an opportunity to pay the fixed charge penalty notice.
Garda Marius Stones told the court that on May 16 last year at 6.55pm he recorded a 151 registered black Audi A6 driving at 141kph on the M6 at Rathgarrett, Westmeath where the 120kph speed limit applied.
Garda Stones added that a fixed charge notice had not been paid but he had no evidence of service of the notice nor had he seen the prosecution pack himself in person.
Judge Andrew Cody dismissed the summons because there was no evidence of the notice having been posted.
