Suspended sentence and fine for man who struck another man in the groin in Tullamore
A MAN who assaulted another man outside a premises in Tullamore was handed down a suspended sentence at the district court last week.
In his evidence, Sergeant James O’Sullivan said that at 1.40am on February 26, 2023, Bernardas Malinovskis,(39) 100, Riverside Apartments, Portarlington, was in O’Connor Square. He had assaulted another man by striking him in the groin.
Gardai spoke to the defendant who was unsteady on his feet and started shouting at the injured party.
Mr Malinovskis, who works as a builder, had seven previous convictions, two for public order. He was also previously convicted of drink driving and suspended for four years.
He apologised to the court and told Judge Andrew Cody that whatever he decided he would follow.
Judge Cody fined him €500 for the assault and sentenced him to one month in prison suspended for one year. He directed him to pay €1,000 to the victim of the assault and fined him €250 for the public order offence of insulting behaviour. He gave him three months to pay.
Mr Malinovskis opted to pay the fines immediately.
